Decision Tuesday On Gov. Hearings To Remove Mayor



DETROIT (WWJ)  -- Wayne County Circuit Court Judge, Robert Ziolkowski will decide on Tuesday if Governor Jennifer Granholm can proceed with hearings to remove Detroit Mayor Kilpatrick from office.  That's the same day the governor is scheduled to begin those hearings.

WWJ Newsradio 950's Florence Walton was in the courtroom during Friday's arguments in a lawsuit to stop the governor.

The attorney for Mayor Kilpatrick argued that the governor is biased, and that the State Constitution is vague and does not explain what "misconduct in office" means.

Governor Granholm's attorney argued that she has not made up her mind and is only responding to a Detroit City Council request that she hold hearings to remove the mayor from office.

City Council's attourney Bill Goodman, who was added to the case, argued that the court lacks jurisdiction, "It's her duty and job under the Constitution to make these decisions," Goodman said.

Judge Ziolkowski said he will study over the holiday weekend and render a decision on Tuesday.
