Court Hearing Over Mayor's Ouster



Both sides will appear in Wayne County Circuit Court Monday as the legal wrangling continues over whether the Detroit City Council can go ahead with hearings to try and remove the mayor from office. 

With word of an FBI probe of the City Council, there has been a question as to whether the council still has the moral authority to conduct the hearings.  City Council Attorney Bill Goodman says it does. 

"There has been a consistent majority on the City Council, five members, who from what everyone says and from what everyone can tell, are not under any cloud whatsoever, who are favoring moving ahead with the forfeiture proceeding," Goodman told WWJ.  "What we have is a clear majority of City Council that wants to proceed, that is not under any moral cloud."

Goodman says the Monday morning hearing will determine just who the two sides in the fight over the forfeiture hearings are.  There will be another hearing to determine whether the City Council actually has the right, under the City Charter, to remove the mayor from office for anything other than a felony conviction or lack of qualifications
 

The council decided to hold the hearings after learning the mayor settled a whistleblower lawsuit for $8.4 million to conceal racy text messages between himself and his former Chief of Staff.
