DETROIT (AP) - The City of Detroit is expected to ask a judge to rule on whether the City Council can go ahead with forfeiture efforts against Mayor Kwame Kilpatrick.
Corporation Counsel John Johnson says the action will be filed Wednesday in Wayne County Circuit Court.
Wayne State University Law School professor Robert Sedler is representing the city and says a two-thirds vote is needed to remove the embattled mayor from office. The nine-person council had voted 5-4 to initiate forfeiture proceedings.
Sedler also says there is no basis of law in the City Charter for the council's action.
Some council members accuse Kilpatrick of duping them into approving an $8.4 million whistle-blowers' agreement.
Kilpatrick is facing perjury and other charges stemming from testimony given in a whistle-blowers' trial.
